Terms and conditions
Article 1 – Definitions
In these Terms and Conditions, the following terms shall have the following meanings:
- Cooling-off period: the period within which the Consumer may exercise the Right of Withdrawal.
- Consumer: a natural person acting for purposes outside their trade, business, craft, or profession who enters into a distance contract with the Seller.
- Day: a calendar day.
- Long-term transaction: a distance contract related to a series of products and/or services, with delivery and/or purchase obligations spread over time.
- Durable medium: any tool that allows the Consumer or Seller to store personal information in a way that permits future consultation and unchanged reproduction.
- Right of Withdrawal: the Consumer's right to cancel the Distance Contract within the Cooling-off period.
- Seller: the natural or legal person offering products and/or services to Consumers at a distance.
- Distance Contract: an agreement concluded between the Seller and Consumer within the framework of an organized system for remote sales of products and/or services, using exclusively one or more means of distance communication.
- Means of distance communication: a method that can be used to conclude a contract without the Consumer and Seller being physically present in the same place.
- Terms and Conditions: these Terms and Conditions of the Seller.
Article 2 – Applicability
These Terms and Conditions apply to every offer from the Seller and to any Distance Contract concluded between the Seller and Consumer.
Before a Distance Contract is concluded, the text of these Terms and Conditions will be made available to the Consumer or provided electronically in a way that allows it to be stored on a durable medium. If this is not reasonably possible, the Seller will indicate how the Terms can be viewed and that they will be sent free of charge upon request.
If specific product or service conditions apply in addition to these Terms, the Consumer may rely on the applicable provision most favorable in case of conflict.
If a provision is invalid or unenforceable, the remaining provisions will remain in effect, and the invalid clause will be replaced by a valid provision that best reflects the original intent.
Situations not covered by these Terms or unclear conditions shall be interpreted in the spirit of these Terms.
Article 3 – The Offer
If an offer has limited validity or is subject to conditions, this will be clearly stated.
Offers are non-binding and may be changed or withdrawn by the Seller.
The offer includes a complete and accurate description of the products/services. If images are used, they represent the products truthfully. Obvious errors or mistakes are non-binding.
All images, specifications, and information are indicative and do not justify claims or cancellations.
Displayed colors may differ from actual product colors and are not guaranteed.
Each offer clearly outlines the rights and obligations involved, including:
- Total price;
- Shipping costs;
- Notification that customs duties, import taxes, or clearance fees (if applicable) are the customer's responsibility;
- How the contract is formed and steps required;
- Applicability of the Right of Withdrawal;
- Payment methods, delivery methods, and timeline;
- Duration of offer validity;
- Whether/how the contract is archived and accessible to the Consumer;
- How the Consumer can review and correct input before placing an order;
- Minimum duration for Long-term Transactions.
Article 4 – The Agreement
An agreement is established when the Consumer accepts the offer and complies with the stated conditions.
If acceptance is electronic, the Seller will promptly acknowledge receipt electronically. Until confirmed, the Consumer may cancel.
If the agreement is formed electronically, the Seller will implement suitable technical and organizational measures to secure data transfer and provide a safe web environment.
The Seller may assess whether the Consumer can fulfill payment obligations or consider other relevant factors. On reasonable grounds, the Seller may reject orders or attach special conditions.
The Seller will deliver the following in a durable manner:
- Contact details for complaints;
- Conditions and procedure for exercising the Right of Withdrawal, or notice if it is excluded;
- Warranty and after-sales service details;
- Termination requirements for contracts longer than one year or indefinite.
For Long-term Transactions, this applies only to the first delivery.
All contracts are subject to sufficient availability of products.
Article 5 – Right of Withdrawal
For product purchases, the Consumer may cancel the contract without giving a reason within 14 days from the day after receiving the product (or a third party designated by the Consumer).
During the Cooling-off period, the Consumer must handle the product and packaging with care, only unpacking/using as necessary to assess characteristics and functionality. If withdrawing, the Consumer shall return the product with all accessories in its original condition and packaging (if reasonably possible) according to the Seller's instructions.
Article 6 – Return Instructions and Deadlines
To use the Right of Withdrawal, the Consumer must notify the Seller within 14 days after delivery by email or in writing. The Consumer then has another 14 days to return the product. Proof of timely return must be available (e.g., tracking number).

Failure to notify or return the product on time confirms the sale.
Article 7 – Costs in Case of Withdrawal
If the Consumer exercises the Right of Withdrawal, return shipping costs are the Consumer’s responsibility unless otherwise agreed or the product is defective/incorrectly delivered.
If payment was made, the Seller will refund promptly, no later than 14 days after withdrawal. Refund may be withheld until the product is received or proof of return is provided, whichever comes first.
Refund may be reduced if the product is used beyond what was necessary to evaluate it.
Article 8 – Exclusions from Withdrawal
Withdrawal may be excluded (if clearly stated before purchase) for:
- Custom-made products;
- Clearly personal items;
- Items that cannot be returned by nature;
- Perishables;
- Items with price fluctuations beyond Seller’s control;
- Single issues of newspapers/magazines;
- Unsealed audio/video recordings or software;
- Sealed hygienic items once opened.
Exclusions for services:
- Accommodation, transport, restaurant, or leisure activities for a specific date;
- Services started with Consumer’s explicit consent during the Cooling-off period;
- Bets and lotteries.
Returns are only accepted if unused, undamaged, and (if possible) in original packaging. Otherwise, only partial refunds may apply.
Article 9 – 28-Day Money-Back Guarantee
In addition to the legal Right of Withdrawal, the Seller offers a 28-day money-back guarantee. The Consumer must notify the Seller within 14 days after receipt (email is sufficient), then return within 14 days. Refunds are issued after inspection. Use trackable shipping. Returns that don’t meet requirements are not refunded.
Article 10 – Prices, Taxes, and Charges
Prices remain unchanged during the offer period unless legally required.
Products/services subject to financial market fluctuations may be offered at variable prices (as indicated).
Price increases within three months of contract are only allowed if required by law; after three months only if required by law or if the Consumer may cancel effective on the increase date.
Sales Tax: Where applicable by U.S. law, state and/or local sales tax will be added at checkout.
Customs & Import: For international orders, the Consumer is responsible for any duties, import taxes, and clearance fees. These are not covered by the Seller.
All prices are subject to typographical and display errors. Obvious pricing mistakes are non-binding.
Article 11 – Conformity and Warranty
The Seller guarantees that products/services comply with the contract, offer details, quality expectations, and current legal standards.
Commercial warranties from Seller, manufacturer, or importer do not affect legal rights.
Defects or incorrect deliveries must be reported within 14 days of receipt. Products must be returned in original packaging and unused unless the defect prevents this.
Unless stated otherwise, warranty duration equals the manufacturer’s warranty. Warranty exclusions:
- Consumer repaired/modified product;
- Exposure to abnormal use or neglect;
- Damage from regulatory changes;
- Normal wear and tear, intentional damage, poor maintenance;
- Opened sealed hygienic items.
If a defect under warranty occurs, the Seller may choose to repair or replace the product free of charge.
Article 12 – Delivery and Execution
The Seller takes utmost care in processing orders.
Delivery is to the address provided by the Consumer, who is responsible for accuracy.
Unless otherwise specified in Article 3, accepted orders will be fulfilled within 30 days unless the Consumer agrees to a longer term. If delayed or impossible, the Consumer will be notified within 30 days and may cancel for a full refund within 14 days.
If a product cannot be delivered, the Seller will attempt a substitute. The Right of Withdrawal still applies unless legally excluded.
Risk of loss/damage passes to the Consumer upon delivery.
Shipments may come from international suppliers. Delivery times vary. Any import fees/taxes are the Consumer’s responsibility.
Article 13 – Ongoing Transactions: Duration, Termination, Renewal
Termination:
- Open-ended contracts for regular product/service delivery may be terminated anytime with 1-month notice.
- Fixed-term contracts may be canceled at the end of the term with 1-month notice.
- Termination must be possible in the same manner as contract initiation.
Renewal:
- Fixed-term contracts cannot auto-renew for a fixed period.
- Temporary contracts may convert to open-ended only if the Consumer can cancel with 1-month notice (3 months if less than monthly delivery).
- Trial/intro subscriptions end automatically.
Duration:
- Contracts over 1 year may be canceled by the Consumer after 1 year with 1-month notice unless impractical.
Article 14 – Payment
Unless otherwise agreed, payments are due within 7 days after the Cooling-off period begins as defined in Article 5. For services, this starts upon contract confirmation.
Consumers must correct outdated or incorrect payment details. Seller is not liable for related delays.
If payment is late, the Consumer will first receive a free reminder. If still unpaid, the Seller may charge reasonable collection fees and interest, and involve a debt collection agency after clear notice.
Payments must be made via Seller’s offered methods. Seller may limit or set conditions.
Article 15 – Complaints Procedure
Complaints must be submitted clearly within 7 days of defect discovery, via email or other provided method.
The Seller responds within 14 days. If more time is needed, the Consumer will receive an acknowledgment and estimated reply time.
Filing a complaint does not suspend Consumer obligations unless confirmed by the Seller.
If the complaint is valid, the Seller will repair, replace, or offer an appropriate resolution.
Article 16 – Dispute Resolution and Governing Law
These Terms and all contracts between Seller and Consumer are governed by U.S. law, and if applicable, the law of the Seller’s principal place of business, excluding conflict-of-law rules.
Unresolved disputes fall under the exclusive jurisdiction of state or federal courts in the Seller’s primary location, unless mandatory law provides otherwise.
This does not prevent either party from seeking injunctive relief or equitable remedies in a competent court.
